Municipalities
other than Chicago:
There is more to life than Chicago! A number of other
municipalities have laws regulating the rights and duties of landlords
and tenants.
Evanston
The
City of Evanston Residential Landlord Tenant Ordinance
was
enacted "in order to protect and promote the public health, safety and
welfare of the citizens, to establish rights and obligations of the
landlord and the tenant in the rental of dwelling units and to
encourage the landlord and the tenant to maintain and improve the
quality of housing". The scope of the ordinance is more broad
than the Chicago ordinance. Security deposits are governed by
Section 5-3-5-1 of the Ordinance. Like Chicago, the penalty
for
violating the security deposit requirements is two times the amount of
the deposit plus reasonable attorney fees.

Mount Propect
The Village of
Mt. Prospect enacted Article XVIII Residential Landlord Tenant
Regulations of the Village Code to govern the relationships of
most landlords and tenants throughout the Village of Mt.
Prospect.
Like Evanston's ordinance, the application of the law is more
broad than Chicago's ordinance.

Oak Park
The
Village of Oak Park has landlord tenant regulations that are a bit
different from other local municipalities. Covered renters
must
agree to pay a security deposit of at least one month's rent and there
are no requirements to segregate the deposit.

Urbana
The
above list is by no means complete. In addition, some
municipalities that have not enacted a specific landlord tenant
ordinance may have various provisions of the municipal code that affect
the landlord tenant relationship. Always check with your local
municipality to know your rights and obligations.
Have
an issue?
If
you believe your landlord has violated the obligation to make a timely
return of your deposit or to pay interest on your deposit, please feel
free to telephone us at 773-399-1122 for a free telephone consultation
(most consultations require approximately ten to fifteen minutes) or email us.
